Kats Botanicals Affiliate Terms

These Terms and Conditions represent the entire agreement and understanding between Katsbotanicals.com and the individual or entity who participates in the Affiliate Program. It is the responsibility of the Affiliate to read and understand every portion of this agreement before the Affiliate registers for this program. By signing up as an Affiliate of this program you are stating that you agree with these terms and conditions set forth by Kats Botanicals Corp.

Being Approved or Rejected
Kats Botanicals.com and Kats Botanicals Corp reserves the right to approve or reject any Affiliate signee. You have no grounds for legal action if you do not get approved for this Affiliate program.

Affiliate Payouts
Affiliate payouts will occur one time per month through the use of Paypal once the Affiliate receives their threshold payment of $100. It is up to the Affiliate to ensure they have a Paypal account that can receive payments. The affiliate is responsible for providing Kats Botanicals with the correct payment information upon signup. Kats Botanicals is not responsible for lost info or mistakes by the affiliate. Any problems on Paypal side of the Affiliate payment processing will need to be dealt with through Paypal support.

Other important Affiliate payment information:

  • Affiliate will be paid in United States Dollars.
  • Affiliate will be paid every month through Paypal as long as the Affiliate has reached the payment threshold of $100 that month.
  • The Affiliate is eligible to receive a 20% commission on every referral who purchases from KatsBotanicals.com.
  • The Affiliate will continue to receive monthly payments as long as their payment threshold meets $100 and their account stays in good standing with Kats Botanicals Corp.
  • Affiliate will get paid as long as none of their referrals have any chargebacks.
  • Any unpaid affiliate fees will be terminated after 12 months.
  • Affiliate will not be paid any commission on referred wholesale orders. Only non-wholesale, retail online orders qualify for affiliate commissions.

Referral Tracking

KatsBotanicals.com and Kats Botanicals Corp uses 30 day cookies. The Affiliate may not modify or alter the referral link or cookies. Doing so will result in termination of your Affiliate account. Your Affiliate network is not for personal use, doing so will result in your removal of the program.

Suspension or Termination
The Affiliate must follow all of the rules of Kats Botanicals.com and Kats Botanicals Corp. The Affiliate in question may be suspended or terminated due to the following reasons:

  • The affiliate may use the Kats Botanicals contact form and terminate themselves if they so desire.
  • Inappropriate ads – false medical claims, false advertising, misleading, etc.
  • Spamming.
  • Promoting Kats Botanicals products on websites that promote illegal activities.
  • Anything that goes against the branding guidelines of Kats Botanicals
  • Vulgar or misleading graphic banners are adverts that do not represent Kats Botanicals in a professional manner.
  • Violation of intellectual property rights of Kats Botanicals.
  • Offering promises like kickbacks or splitting commissions from referrals in order to get them to purchase from your affiliate link.

Kats Botanicals Corp reserves the right to terminate any Affiliate at any time for violation of these rules or with any reason without explanation.

Affiliate Marketing
You may use your affiliate link in your website in a blog post, or use one of our professionally edited banner advertisements for your blog’s sidebar. Feel free to advertise anywhere they allow CBD products to be marketed. Online & offline classifieds, email lists, etc. are fine as well. Our graphics are there to help you succeed and you may use these at your leisure. If you choose to design your own graphics or logos make sure they abide by our branding guidelines.

Liability
Kats Botanicals and its Affiliate program is not liable for lost commissions or mistaken information that causes delays in affiliate payouts. We are not responsible for loss of commission due to tracking errors, database files, or any attacks against our website which could affect the affiliate. Kats Botanicals does not warrant or guarantee with respect to our affiliate program. We make no claims that your business will make any commissions using our affiliate program whatsoever. We do not guarantee the affiliate program will be error-free and without failures. Sometimes operational features produce mishaps and we cannot be liable for those errors. Our technical staff will do their best to ensure the affiliate platform continues to run as efficiently as possible. If there is a delay of any kind, Kats Botanicals Corp will do their best to get the platform up and running but do not guarantee any time frame and the Affiliate agrees that we are not liable for these instances.

Terms of Affiliate Agreement
The Affiliate Agreement terms begin upon the affiliate’s acceptance into the KatsBotanicals.com affiliate program and ends when affiliate becomes terminated or decides to leave of their own accord. This Affiliate Agreement Terms may be modified or changed by Kats Botanicals at any time without informing or consenting the affiliates registered. All affiliates do have the option to cancel their personal affiliate account if they are not pleased with these changed to the Affiliate Terms Agreement. The Affiliates who continue to stay with Kats Botanicals during these changes mean the affiliate agrees with the changes made by Kats Botanicals to the Affiliate Agreement.

Indemnification
Kats Botanicals Corp, its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those people licensed or authorized by Kats Botanicals Corp shall be indemnified and be held harmless by the Affiliate. This includes indemnification from transmit and distribute materials, from all liabilities, personal damages, fines or other charges, judgments, claims, costs, losses, and any expenses (including legal fees and other costs) arising out of any claim discovered in this Agreement due to negligence, misrepresentation, disclosure failure, or intentional misconduct by the Affiliate.

Governing Laws, Jurisdiction, and Attorney Fee
This agreement between Kats Botanicals and the affiliate has been constructed within the laws of the United States and the State of New Jersey. Any dispute which shall arise in any related fashion to this agreement shall be created exclusively in the state courts located in Bergen County, Hackensack, NJ. In the event where litigation occurs, enforcement of any provision of this Agreement, the winning party will be eligible to recover from the other party its costs and fees associated with this Agreement, including all reasonable legal fees.

Electronic Signature Effective
The Agreement held between the affiliate and Kats Botanicals is an electronic contract that is holding the affiliate to legally binding terms in the participation of KatsBotanicals.com affiliate program. The affiliate indicates their acceptance of said Agreement, and all of the terms and conditions referenced to or contained in this Agreement when they complete the KatsBotanicals.com affiliate application process. This actionable agreement creates an electronic signature that holds the same legal force and effectiveness as a handwritten signature.
