Major updates to how the DEA is classifying Kratom and Kratom related products. On July 1, the DEA announced its intent to temporarily place 7-OH above a specified threshold, and the required 30-day notice period has now passed. This means the DEA can issue the temporary orders beginning August 5, but nothing has been finalized just yet. This new proposal would focus on products containing more than a certain allowed threshold of 7-OH. Natural Kratom is not included.

What Is the Proposed 7-OH Threshold?
The DEA has proposed a federal limit of 0.050% 7-OH in botanical material. Finished products may also be restricted if they exceed 0.050% 7-OH or contain more than 1 milligram per serving or article.  P.S. That’s not a lot…

Minnesota Raises the Kratom Age to 21
Beginning August 1st, Minnesota raised the minimum purchasing age for Kratom products from 18 to 21. This is a possible step towards further increased enforcement in the state.

California Steps Up Enforcement
California recently finished thousands of retail inspections of Kratom and other regulated products. Officials reported removing nearly 7,000 noncompliant products, but found that most inspected retailers were following the rules.

More States Focus on Concentrated 7-OH
Kansas recently scheduled several substances related to concentrated 7-OH, including Kratom. Florida, Ohio, New York, Michigan, Utah, Georgia, and other states are also considering or enforcing new Kratom and 7-OH rules.
