The “wait and see” phase of Kratom legislation hasn’t just ended. Governor Lee officially signed Matthew Davenport’s Law, making the July 1, 2026 ban a reality. On that date, Kratom becomes a controlled substance; possession will be a Class A misdemeanor, and sale a Class C felony. The federal landscape is shifting in lockstep. The FDA and CDC are narrowing their focus to 7-OH and high-potency extracts. By isolating these concentrated products from natural leaf, they have provided state lawmakers with a “cleaner” target for prohibition—a shift clearly reflected in Tennessee’s sweeping new law.
Here’s where things stand state by state:
- Illinois has two competing bills on the table: One building toward KCPA-style regulation, the other going for an outright ban. It’s not “leaning” to one side or the other any more. Now, it’s a fight.
- Idaho has cooled off. Advocacy work has stalled the proposed ban, so we’ve got some breathing room there, but only for now.
- Arizona and Ohio are both moving toward regulation rather than prohibition, looking to introduce labeling rules, packaging standards, and sales restrictions. That’s a much better outcome than what we were watching for a month ago.
- Iowa is still the one to watch. Schedule I efforts haven’t gone away, and more advocacy is needed.
