In many states where Kratom is legal, legislatures are considering bans or increased regulation of Kratom. Kratom use is currently legal in New York State, but advocates are closely watching several pieces of legislation.
NY State Assembly Bill A4376 was introduced in the 2023-2024 Legislative Session. It prohibits the sale of Kratom to individuals under the age of twenty-one. This bill passed both the Assembly and Senate, but was stricken. Some counties have age restrictions, but it is possible for those 18 years and older to purchase Kratom in many areas and municipalities.
NY Assembly Bill A9034 relates to enacting the state’s Kratom Consumer Protection Act (KCPA). This bill has also passed both the Assembly and Senate, and Governor Hochul will either veto or sign the KCPA. This bill specifies labeling and other requirements for the sale of Kratom products in the Empire State.
