Last month, we talked a lot about Tennessee and the reality of incoming restrictions. This month, there’s a bigger picture becoming clearer in the Kratom industry. Regulators, lawmakers, and public health officials are no longer treating every kratom product as the same thing. The market is being separated into natural leaf kratom, responsibly made kratom products, and high-potency 7-OH products. This separation of products is important. Because responsible vendors should not be grouped together with unclear, chemically altered, or overly concentrated products.

INDUSTRY INSIGHTS: IT NOT “IS KRATOM LEGAL?”, NOW IT’S “WHAT KIND OF KRATOM IS THIS?”
The biggest shift happening this month is not one single law coming into effect, but how kratom products are being categorized. Natural leaf kratom and concentrated 7-OH products are increasingly being discussed separately, and the high-potency 7-OH products are getting a lot more scrutiny from regulators and lawmakers.
We see this as a good thing. But this closer scrutiny can affect the entire category when laws are written too broadly.
- Tennessee remains the clearest warning sign because its July 1, 2026 law affects natural leaf kratom too.
- Georgia has created a special committee, the “Blue-Ribbon Study Committee on Youth Exposure to Kratom and Retail-Available Substances”, to discuss kratom. And it’s to be chaired by very outspoken kratom critic Rep. Rick Townsend.
- Minnesota is moving toward stricter age access, raising the legal age to 21 on August 1, 2026.
- New York has moved toward limits aimed specifically at products with higher 7-OH content.
- Ohio Board of Pharmacy issued an Emergency ban on most kratom products effective 5/19/26. Under the new state rule, only natural kratom in its vegetation form remains legal to sell or own.
The future of kratom access may heavily depend on lawmakers understanding the difference between natural leaf and concentrated 7-OH. So the real question is quickly changing from ”Is kratom legal in my state?” to “What type of kratom product is legal?” This means that natural leaf products, clear serving information, responsible labels, and third-party testing matter more than ever.
